    and Facebook Ireland Ltd. ("Facebook") within the meaning of Art. 26 EU General Data Protection Regulation (GDPR). This results from the fact that Automobile Dürr GmbH as operator of the Facebook page, by setting up such a page, gives Facebook the opportunity to place cookies on the computer or any other device of the person visiting the Facebook page ("visitor"), regardless of whether the visitor has a Facebook account.

    Facebook assumes primary responsibility under the GDPR for the processing of Insights data within the framework of joint responsibility and fulfills all obligations under the GDPR regarding the processing of Insights data (including Articles 12 and 13 GDPR, Articles 15 to 22 GDPR and Articles 32 to 34 GDPR). Furthermore, Facebook makes the essence of this Page Insights Supplement available to data subjects (the corresponding "Page Insights Controller Addendum" can be found here:
    https://www.facebook.com/legal/terms/page_controller_addendum).

    Below you will find a description of how personal data is handled by Automobile Dürr GmbH and Facebook when visiting the Facebook page. However, since Automobile Dürr GmbH generally or largely has no influence on the data collected by Facebook and its processing by Facebook, we cannot yet provide conclusive information on the purpose and scope of processing your data by Facebook. However, we will monitor further developments in this regard and adapt this privacy policy accordingly if necessary.

    We point out that you use this Facebook page and its functions at your own responsibility. This applies especially to the use of interactive functions (especially commenting, sharing, rating).

    5. Legal basis for processing personal data

    Insofar as consent of the data subject is obtained for processing operations of personal data, Art. 6 para. 1 sentence 1 lit. a (GDPR) serves as the legal basis for processing personal data.

    When processing personal data that is necessary for the performance of a contract to which the data subject is party, Art. 6 para. 1 sentence 1 lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary for carrying out pre-contractual measures.

    Insofar as processing of personal data is necessary to fulfill a legal obligation to which Automobile Dürr GmbH or Facebook is subject, Art. 6 para. 1 sentence 1 lit. c GDPR serves as the legal basis.

    In the event that vital interests of the data subject or another natural person require processing of personal data, Art. 6 para. 1 sentence 1 lit. d GDPR serves as the legal basis.

    If processing is necessary to protect a legitimate interest of Automobile Dürr GmbH, Facebook or a third party and the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 para. 1 sentence 1 lit. f GDPR serves as the legal basis for processing.

    6. Opposition and removal options

    The visitor has the opportunity at any time to withdraw their consent to the processing of personal data (see also rights of data subjects). If the visitor contacts us by email, they can object to the storage of their personal data at any time.

    The collection of data for providing the Facebook page and the storage of data in log files is absolutely necessary for the operation of the Facebook page. Consequently, there is no possibility of objection on the part of the visitor.

    Right to information about the data stored about you at Automobile Dürr GmbH or Facebook;

    Right to rectification, deletion or restriction of processing of your personal data;

    Right to object to processing that serves the legitimate interest of Automobile Dürr GmbH or Facebook, a public interest or profiling, unless Automobile Dürr GmbH or Facebook can demonstrate compelling legitimate grounds for processing that override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims;

    Right to data portability;

    Right to complain to a supervisory authority;

    Right to revoke your given consents to the collection, processing and use of your personal data at any time with effect for the future.

    If you wish to exercise your rights, you can direct your request to both Automobile Dürr GmbH and Facebook. For this purpose, you can use the contact options listed above, for example. If you contact us, we will forward your request to Facebook insofar as it concerns questions regarding the processing of Insights data. Facebook will answer requests in accordance with the obligations incumbent on us according to the Page Insights Supplement.
    II. PROCESSING OF PERSONAL DATA BY Automobile Dürr GmbH

    1.    Purpose of data processing

    Automobile Dürr GmbH maintains online presences within social networks to communicate with interested parties and users active there and to inform them about our products, events and news.
    When you visit our Facebook page (regardless of whether you are logged into your Facebook account or not), your browser technically transmits certain data to the web server operated by Facebook. In addition, Facebook uses so-called "cookies". Cookies are small text files that are stored via your browser in the memory of your terminal device. Cookies set by Facebook are intended, among other things, to enable Automobile Dürr GmbH, as operator of the Facebook page, to obtain statistics that Facebook creates based on visits to this page for the purpose of controlling the marketing of our activities.

    2.    Description and scope of data processing

    As operator of the Facebook page, Automobile Dürr GmbH can receive anonymized statistical data concerning visitors to our Facebook page with the help of the Facebook Page Insights function, which Facebook provides to us free of charge as an integral part of the user relationship. This data is collected with the help of cookies set by Facebook, each containing a unique user code that Facebook stores on the terminal device of visitors. The user code, which can be linked to the registration data of users registered with Facebook, is collected and processed when the Facebook page is accessed.

    In particular, the fan page operator can receive demographic data provided by Facebook about their target group – and thus the processing of this data – including trends in age, gender, relationship status and professional situation, information about the lifestyle and interests of their target group and information about the purchases and online purchasing behavior of visitors to their page, the categories of goods or services that interest them most, as well as geographical data that informs them where to conduct special promotional campaigns or organize events, and generally enables them to design their information offering as targeted as possible.

    Although the visitor statistics created by Facebook are transmitted to Automobile Dürr GmbH as operator of the Facebook page exclusively in anonymized form, the creation of these statistics is based on the prior collection – through cookies set by Facebook on visitors' terminal devices – and processing of the personal data of these visitors for these statistical purposes. Further information about Facebook Page Insights can be found at:

    https://de-de.facebook.com/legal/terms/information_about_page_insights_data

    https://de-de.facebook.com/help/pages/insights

    Data on Facebook groups linked to our Facebook page is also provided in this way. Due to the constant development of Facebook, the availability and preparation of data changes, so for further details we refer to the corresponding Facebook privacy notices mentioned in the previous paragraph and below under "PROCESSING OF PERSONAL DATA BY FACEBOOK".

    We use this data available in aggregated form to make our posts and activities on our Facebook page more attractive to users. For example, we use age and gender distributions for adapted addressing and users' preferred visiting times for temporally optimized planning of our posts. Information about the types of terminal devices used by visitors helps us to adapt the posts visually and design-wise. According to Facebook's terms of use, which every user has agreed to when creating a Facebook profile, we can identify subscribers and fans of the page and view their profiles as well as other shared information from them.

    In addition to this automatically collected anonymized data, we also process the data that you have voluntarily provided to us in the context of, for example, comments on posts or contact requests.

    Insofar as you click the link https://www.kfz-duerr.de/imprint.html (you are currently on this page) that is posted on Automobile Dürr GmbH's Facebook fan page, you will reach a subpage of Automobile Dürr GmbH's website. Personal data is also processed on this page. The privacy policy applicable to these pages can be found here: https://www.kfz-duerr.de/imprint.html

    3.    Data deletion and storage duration

    Personal data is deleted or blocked as soon as the purpose of storage ceases to apply. Storage may also be necessary if this has been provided for by the European or national legislator in Union legal regulations, laws or other provisions to which Automobile Dürr GmbH is subject. Blocking or deletion of data also occurs when a storage period prescribed by the aforementioned standards expires, unless there is a need for continued storage of data for conclusion or fulfillment of a contract.

    III. PROCESSING OF PERSONAL DATA BY FACEBOOK

    Facebook does not definitively and clearly state in what way Facebook uses data from visits to Facebook pages for its own purposes, to what extent activities on the Facebook page are assigned to individual users, how long Facebook stores this data and whether data from a visit to the Facebook page is passed on to third parties, and this is not fully known to us. However, we will monitor further developments in this regard and adapt this privacy policy accordingly if necessary. The following information is based on information publicly provided by Facebook regarding the processing of personal data when using Facebook products.

    1.    Purpose of data processing

    According to its own statements, Facebook processes personal data of visitors for the following purposes:

    • Providing, personalizing and improving Facebook products;
    • Providing measurements, analytics and other Facebook services;
    • Promoting safety, integrity and security;
    • Communication with Facebook users;
    • Research and innovation for social purposes.

    Further information on the purposes of data processing by Facebook can be found in the Facebook Data Policy:
    https://de-de.facebook.com/policy.php

    Further information on Facebook's legitimate interests regarding the processing of personal data can be found here:
    https://de-de.facebook.com/about/privacy/legal_bases

    When you visit our Facebook page (regardless of whether you are logged into your Facebook account or not), your browser technically transmits certain data to the web server operated by Facebook. In addition, Facebook uses "cookies". Facebook uses cookies, among other things, to provide Automobile Dürr GmbH as operator of the Facebook page with statistics for the purpose of controlling the marketing of our activities. Further information on the use of cookies by Facebook can be found in the Facebook Cookie Policy: \nhttps://de-de.facebook.com/policies/cookies/

    2.    Description and scope of data processing

    a)    What types of information does Facebook process?

    To provide Facebook products, it is necessary for Facebook to process information about visitors. The types of information collected by Facebook depend on how the visitor uses Facebook products. The following information may be processed by Facebook:

    Things done and provided by visitors and others such as information about how the visitor uses Facebook products, information about transactions conducted on Facebook products, or information about people, pages, accounts, hashtags and groups the visitor is connected to.

    Device information such as device attributes, identifiers, networks and connections, and cookie data.

    Information from partners, whereby advertisers, app developers and publishers can send Facebook information via the Facebook Business Tools they use, including social plugins (such as the "Like" button), Facebook Login or the Facebook Pixel. These partners provide Facebook with information about visitor activities outside of Facebook.

    Facebook also uses cookies that are set on the visitor's terminal device when the Facebook page is accessed, regardless of whether the visitor is logged into their Facebook account or not. In addition, Facebook also processes information stored in cookies when a person visits Facebook services, services provided by other members of the Facebook corporate group, and services provided by other companies that use Facebook services. Other entities such as Facebook partners and other third parties may also use cookies on Facebook services to provide services to Facebook or companies advertising on Facebook. Further information on the use of cookies by Facebook can be found in the Facebook Cookie Policy:
    https://de-de.facebook.com/policies/cookies/

    When accessing a Facebook page, the IP address assigned to your terminal device is transmitted to Facebook. According to Facebook, this IP address is anonymized (for "German" IP addresses) and deleted after 90 days. Facebook also stores information about its users' terminal devices (especially within the framework of the "login notification" function); Facebook may thus be able to assign IP addresses to individual users.

    If you want to avoid this, you should log out of Facebook or deactivate the "stay logged in" function, delete the cookies on your device and close and restart your browser. This way, Facebook information that can directly identify you is deleted. This allows you to use our Facebook page without revealing your Facebook identity. If you access interactive functions of the page (like, comment, share, messages etc.), a Facebook login screen appears. After any login, you are again recognizable to Facebook as a specific user.

    Information on how to manage or delete information about you can be found on the following Facebook support pages:
    https://de-de.facebook.com/about/privacy.

    Further information on the types of information Facebook processes can be found in the Facebook Data Policy:
    https://de-de.facebook.com/policy.php

    b)   How is information processed by Facebook shared with others?

    Facebook works with third-party partners who help Facebook provide and improve its products, or who use Facebook Business Tools to grow their business. Information may be shared by Facebook with the following third parties:

    • Partners who use Facebook analytics services;
    • Advertisers;
    • Measurement partners;
    • Partners who offer goods and services in Facebook products;
    • Vendors and service providers;
    • Researchers and academics;
    • Law enforcement or enforcement agencies or legal requests.

    Further information on data that Facebook may share with third parties can be found in the Facebook Data Policy:
    https://de-de.facebook.com/policy.php

    c)    How does Facebook process and transmit data as part of its global services?

    Facebook shares information worldwide, both internally among Facebook companies and externally with its partners as well as with persons or organizations that the visitor connects with and shares with around the world. Data may also be transmitted to and processed in the USA or other third countries that do not have an adequate level of data protection. In this regard, Facebook uses standard data protection clauses approved by the European Commission or relies on adequacy decisions issued by the European Commission regarding certain countries.

    Further information on data transfers by Facebook can be found in the Facebook Data Policy:
    https://de-de.facebook.com/policy.php

    3. Data deletion and storage duration

    Facebook stores data until it is no longer needed to provide its services and Facebook products, or until the user's Facebook account is deleted, whichever comes first. This is a case-by-case determination and depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational storage needs.

    Further information on data deletion and storage duration can be found in the Facebook Data Policy:
    https://de-de.facebook.com/policy.php

    Regarding the storage duration of cookies set by Facebook, you can find further information in the Facebook Cookie Policy:
